Lawful use required

Services must be used for lawful purposes only. Illegal content, criminal activity, and specific prohibited categories are strictly forbidden.

IP addresses and network resources must be used responsibly. No abuse, resale, or excessive consumption is permitted.

Lawful Use Requirements

The Internet is a shared resource. SiteHarbour Services are provided for use by multiple individuals and entities and must only be used for lawful purposes in accordance with this policy and our Terms of Service.

You must not transmit, distribute, or store material, data, or information that violates the laws of any country, any U.S. federal, state, or local regulation, or that facilitates or encourages violations of law.

The distribution of child sexual abuse material, child erotica, or bestiality is strictly and absolutely prohibited, regardless of local legality. SiteHarbour maintains a zero-tolerance policy for these activities and will report suspected violations to appropriate law enforcement authorities.

Responsible and Positive Use

  • Email communications must only be sent to recipients who have explicitly consented in advance. You must maintain evidence of consent. Unsolicited email is prohibited.
  • The Services must not be used to provide hacking instructions, malware development, or malicious conduct of any kind.
  • Your use must not negatively impact other users' ability to access or use the Services.
  • You must not collect, harvest, or use email addresses, screen names, usernames, or other personal identifiers without explicit consent from the individual.
  • The Services may only represent you or your End Users. Impersonation, spoofing of email headers, domain spoofing, or misrepresentation of identity is strictly prohibited.
  • Your conduct must comply with generally accepted Internet standards and norms. Any activity that could cause retaliation against SiteHarbour, render our network vulnerable to DDoS attacks, or compromise network security is prohibited.

IP Address and Resource Usage

  • IP addresses assigned to you must not be listed on blacklists or abuse databases as a result of your conduct or the conduct of your End Users.
  • Assigned IP addresses must not be sold, rented, leased, or transferred to other parties.
  • You must use the Services in a reasonable manner, respecting shared resources and network capacity. Excessive or disproportionate usage that degrades service quality for other users constitutes a violation of this policy.

Software License Restrictions

Software provided as part of the Services is sublicensed to you solely for permitted use within the Services. You may not further sublicense, resell, rent, or use the software for purposes beyond those expressly permitted in the Terms of Service, this policy, or accompanying documentation.

Any software license or access you receive may include additional restrictions specific to that software. SiteHarbour does not provide technical support for software obtained through the Services or independently.

Prohibited Activities and Content

Unsolicited commercial email (spam) is strictly prohibited. The Services are not intended for bulk email campaigns exceeding 500 recipients or mailing list operations. Campaigns targeting 500 or more recipients must use a dedicated email service provider.

Even campaigns with fewer than 500 recipients may be treated as spam if they generate excessive complaints, disrupt network operations, or trigger negative actions from other Internet providers. Compliance with the CAN-SPAM Act alone does not guarantee compliance with this policy.

The following activities and content are prohibited and may result in account suspension or termination:

Prohibited Activities Include

  • Distribution, hosting, or promotion of pornography or sexually explicit content
  • Excessive consumption of network resources (exceeding 10% allocation)
  • Obscene, hateful, or abusive language and conduct
  • Threats, promotion of violence, or encouragement of harm
  • Defamatory statements or harassment of individuals or organizations
  • Gambling, pyramid schemes, or Ponzi schemes
  • Forgery, falsification, or deletion of message headers, IP addresses, or return information to conceal origin
  • Creation or distribution of viruses, worms, Trojan horses, malware, botnets, or similar tools
  • Denial-of-service attacks, network flooding, or mail bombing
  • Hacking, attempted unauthorized access, or assisting others in compromising security
  • Solicitation of illegal activities or criminal conduct
  • Hosting content promoting illegal activities or activities that expose SiteHarbour to legal liability
  • Distribution or linking to pirated software, warez archives, or hacking tools
  • Infringement of intellectual property rights, including copyrights, trademarks, patents, or trade secrets
  • Conducting activities that could subject SiteHarbour to regulatory action, legal liability, or reputational harm
  • Unauthorized access to or intrusion into accounts, systems, or communication infrastructure
  • Use of opt-out mechanisms that violate anti-spam regulations
  • Any activity that violates applicable law or this Acceptable Use Policy

Copyright Compliance (DMCA)

SiteHarbour respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We may suspend or terminate accounts found to infringe copyright or violate intellectual property rights.

To report copyright infringement, please provide written notice to our Copyright Agent with the following information:

  • Description of the copyrighted work that has been infringed
  • Location of the infringing material on our platform
  • Your contact information (address, telephone, email)

U.S. Export Control Compliance

Your use of the Services is governed by U.S. export control laws and regulations, regardless of your location or nationality. You may not use the Services in violation of these laws, including exporting prohibited items or technology.

You must not provide services, products, or access to individuals, organizations, or countries subject to U.S. sanctions, embargoes, or export restrictions. Violation of export control laws may result in civil and criminal penalties.

Policy Enforcement

Violations of this Acceptable Use Policy may result in immediate action, including account restriction, service suspension, or termination without notice. SiteHarbour reserves the right to investigate suspected violations and pursue legal remedies.

SiteHarbour may investigate violations at your cost, cooperate with law enforcement, and disclose your information as required by law or court order.

This Acceptable Use Policy is part of the Agreement and is incorporated by reference into your Terms of Service. Additional terms may apply to specific services or features.
